TERMS OF USE AND PRIVACY RULES FOR THE DELICIOUS ZAGREB WEBSITE 

Academy of Gastronomy j.d.o.o. (hereinafter: Delicious Zagreb) developed this online gastronomic guide for the purpose of promoting Zagreb's gastronomic product.

A person who uses the website https://www.deliciouszagreb.hr/ (hereinafter: the User) unconditionally agrees to the application of these Terms of Use and is considered to be able to accept these Terms of Use and to understand all the risks associated with the use of the content published and available here. 

The use of the content available on the website (regardless of whether it is freely available to any User or limited access through the use of secure information technology systems and applications) is permitted exclusively in the manner and under the conditions specified in these Terms of Use. 

Any other use of the content available on the website is subject to appropriate legal protection and the application of appropriate and legally permissible measures against the User and/or a third party who benefits from such use of the content available here. 

Published Content
‍Text, graphics, trademarks, logos, photographs, phonograms, videograms, and other audiovisual content, computer applications, and databases, as well as all other informative or technical materials, regardless of how they are displayed, published, or their availability to the User. 

Intellectual property right 
The content published on the website is protected by the regulations of intellectual property rights, so any unauthorized use of it can be the basis for initiating proceedings for the protection of rights against the User by the copyright holder or a third party who is an authorized copyright holder. When publishing the author's content, it will be possible to display the name of the author of the content, i.e. the copyright holder, in the way that it is optimally possible to do this without major costs or the implementation of special technical solutions.

Availability of websites 
Delicious Zagreb cannot guarantee the availability of Internet pages at all times and through every type of device and browser, as well as every communication connection. Websites may be temporarily or longer, fully or partially unavailable for technical and other reasons (maintenance, errors, unavailability of communication links, force majeure, decisions of public authorities, etc.). Delicious Zagreb cannot be held responsible for any damage caused by the unavailability of websites. Delicious Zagreb can at any time carry out changes to websites in any way and in any form, which includes changes in visual identity, design and architecture, content management system, and other application solutions related to the functioning of websites. 

The character of the published content and the responsibility of Delicious Zagreb 
The content published and available through the Delicious website is exclusively informative and obtained from reliable sources, without any guarantee of any kind, express or implied, that it is accurate, timely, complete and/or suitable for a specific purpose or a specific method of use. The User uses the stated content solely at his own risk, and Delicious Zagreb cannot be held responsible for any damage caused by its use or interpretation. 

The published content and information do not in any sense constitute an offer or invitation to make an offer to trade or any other transaction in connection with the published content and information. 

The manner and purpose of using the content 
Delicious Zagreb grants the User a limited, non-transferable, and non-exclusive license to view, print, copy, or otherwise use the content of these websites exclusively for their personal and non-commercial use, i.e. for the purpose of promoting Zagreb as a tourist destination, provided that the downloaded content is not altered or denigrated in any way (including the publication of morally inappropriate content on internet pages) and with indicated Delicious Zagreb as the source and the name of the author of the said content along with the downloaded content. 

Any other way or purpose of using the content is permitted only with the prior written consent of the legal copyright holder of the content, exclusively by the person to whom such consent was given and in the manner and for the purpose specified in that consent.No photocopies from these websites may be used for commercial purposes (production of tourist guides, postcards, and similar materials intended for direct sale). 

In the case of the unauthorized use, the authors will initiate legal proceedings against the user for unauthorized use and copyright infringement. 

A legal or private person who uses photos from these websites is obliged to state when publishing them that they are the property of archive Delicious Zagreb, as well as to state the name and surname of the author of the photo. 

How to access websites and published content 
Access to the Internet pages is provided to an unlimited number of people with appropriate computer equipment and an Internet connection. Delicious Zagreb reserves the right to, in certain cases (maintenance, errors, unavailability of communication links, force majeure, decisions of public authorities, etc.) temporarily or for an extended period of time, in whole or in part, limit the method and possibility of accessing the website in part or in whole, so that all Users as well as to an individual User or a group of Users. In any of the above cases, Delicious Zagreb cannot be held responsible for any damage caused by restricting access to websites and published content. 

When accessing websites and content, the User must use standard technical equipment and the usual standards and methods of accessing websites. The content published on the Internet pages can be searched only by applying permitted methods of information technology, in the manner and in the quantity and extent that is usual for a natural person of the User. Any other way of searching and/or using content that bypasses protected information technology systems and applications, or in which specific applications or tools are used for the simultaneous download of an amount of data that is not usual for a natural person of the User, constitutes a violation of the protected right of Delicious Zagreb, for which the User bears responsibility appropriate material, criminal or misdemeanor liability. 

Third-party content 
Websites may contain third-party content, such as forums, screensavers, applications, and the like, which third parties may independently download or create. 

Delicious Zagreb does not guarantee that such content is completely free from the rights of third parties, especially in part related to intellectual property.

Delicious Zagreb is in no way responsible for the content on external data sources to which links from these websites may lead, nor is it responsible or refers to the manner and conditions of use of such content. 

Delicious Zagreb cannot guarantee the availability of external content or the correct functioning of links to it. It cannot be held responsible for any damage caused by the use of such content or access to it. The user is obliged to independently decide whether and how to access the same through links on these websites and is independently responsible for such actions, and is aware of the consequences that may arise from taking them.

Dispute Resolution and Governing Law 
All possible disputes in connection with these Terms of Use, including disputes related to the question of their origin, content or termination, will try to be resolved peacefully. In the event that they fail to do so, they agree to the jurisdiction of the Zagreb Municipal Court. 

These Terms of Use are drawn up in accordance with Croatian law, and Croatian law applies to them and to disputes arising from them without applying the provisions of Croatian law on reference to third rights (renvoi) in the part where this is allowed by international regulations. Protection of privacy and collection of information about Users

Delicious Zagreb respects the privacy of its website users. Data from the registration process and other data about the User will not be disclosed to a third party, nor will they be available to a third party, except when such an obligation is regulated by applicable regulations.

The cookie policy describes the types of cookies and purposes Delicious Zagreb uses them and instructs the User to refuse to accept the use of cookies or to accept them, thereby agreeing to the manner and purpose of their use, and in the specified case, Delicious Zagreb cannot be held responsible for any damage caused by the storage and use of cookies in the manner and for the purpose agreed to by the User by accepting the Cookie Policy.The cookie policy is published separately from these Terms of Use, but is an integral part of them. 

When accessing Delicious Zagreb websites, it may temporarily store the User's IP address. IP addresses can be stored and used exclusively for the purpose of monitoring the User's activities on the Internet (activity log) for the purpose of detecting violations of legal regulations or these Terms of Use, determining illegal or other unacceptable actions. Data on IP addresses and monitoring of the User's activities can be transferred at any time to the relevant public authorities to determine any legal liability of the User. The storage of the IP address and data on the User's activities is done temporarily, for a maximum period of one month.

We collect, use and process your data in accordance with this Privacy Policy and the provisions of the Personal Data Protection Act, i.e. other valid regulations applicable in the Republic of Croatia that govern the protection of personal data. Delicious Zagreb will take the necessary measures to protect your personal data from unauthorized access, disclosure, modification or destruction and will keep personal data as precise and up-to-date as possible. 
We use the data obtained from you and about you for one or more of the following purposes:
- collected information about you helps us to respond better to your individual needs and requests; 
- for the purpose of operating as efficiently as possible and for the purpose of improving the website (we are constantly working on improving the website based on feedback received from users);

We store the collected data only for the period during which you receive the newsletter and you have not canceled your consent to receive the Newsletter. 

Data processing for receiving the newsletter is necessary for the needs of our legitimate interests. Therefore, you are not obliged to provide this information and/or consent to receive the newsletter. The legal basis for receiving the newsletter is your consent (Article 6, paragraph 1 of the General Data Protection Regulation). Changes to the terms of use and privacy policy 
Delicious Zagreb reserves the right to change these Terms of Use and the Privacy Policy at any time and is not and will not be responsible for possible consequences resulting from such changes. The aforementioned changes come into force on the day of publication on these websites.
